The U.S. Supreme Court ruling that overturns Roe v Wade raises many questions as to what happens now in states.
鈥淭his is a watershed ruling,鈥� says Marc Spindelman, Professor at Ohio State University鈥檚 Mortiz College of Law. 鈥淥ne of the most significant constitutional decisions of a generation.鈥�
Spindelman said further action on abortion rights will now be in the hands of state lawmakers.
"The decision that came down today will certainly pave the way for legislatures, including Ohio's, to take up various forms of pro-life, anti-abortion legislation,鈥� said Spindelman. 鈥淚t is a decision that is leaving different folks in our communities, those who support women鈥檚 right to choose and those who oppose it, with a very different sense of the constitutional and political possibilities for the causes that they hold dear in the days to come.鈥�
Spindelman said he disagrees with Supreme Court Justice Clarence Thomas that challenges to other privacy cases under the Fourteenth Amendment should be re-examined such as the Obergefell decision legalizing same-sex marriages.
"There is an important separate opinion written by Supreme Court justice Kavanaugh, the swing justice in the case, underscoring that the majority opinion's today is limited to deciding the abortion question,鈥� said Spindelman.
