After a jury couldn鈥檛 agree on a verdict, a former Columbus police officer will be retried, Franklin County prosecutors confirmed Friday.

Andrew Mitchell was for the August 2018 shooting death of 23-year-old Donna Castleberry. A Franklin County judge after the jury on the case remained deadlocked.

The process for the retrial will begin on June 9.

Defense attorney Mark Collins said his team is prepared to defend Mitchell again.

"We're ready to retry this case, the sooner the better, and although we're disappointed with the decision to retry, we'll be ready to advocate to the best of our abilities to show that this was a reasonable and justified use of force," Collins said.

Prosecutors argue Mitchell used an unreasonable amount of force when Castleberry tried to escape him. Prosecutors said Castleberry thought Mitchell was trying to kidnap and rape her.

The defense argued Mitchell was acting in the line of duty while trying to make a prostitution arrest and acted to protect himself.

Mitchell is scheduled to go on trial in July on federal charges in the U.S. District Court for the Southern District of Ohio. There he was on charges that include depriving people of their Constitutional rights -- by using his badge to kidnap them force them into sex acts. Other charges allege he then tried to cover it up by lying to investigators and tampering with witnesses.

Collins also represents Mitchell on that case, and filed a request with the federal court earlier this week asking that trial be postponed until the Franklin County case is resolved.

Collins said he doesn't know if the court will agree to move the trial dates, but they would like to finish the murder trial before the federal one begins.

The Franklin County jury did not hear about Mitchell's federal case during proceedings in mistrial.
