The Ohio Supreme Court has ruled an anti-gambling group fighting Gov. John Kasich's decision to legalize slots-like video lottery terminals at seven horse tracks lacks standing to sue while another plaintiff can continue his challenge.
The court ruling Thursday upholds a lower court's ruling that the Ohio Roundtable lacked legal standing in the case.
The group filed its lawsuit in October 2011 against Kasich, the Ohio tax commissioner, the Ohio Lottery Commission, the Ohio Casino Control Commission and associated members of the commissions.
The suit argued it was unconstitutional for Kasich to expand the lottery without putting the question to voters. Attorneys for the state say the governor was within his rights.
An attorney for the Ohio Roundtable and the Ohio attorney general's office didn't immediately return calls Thursday.
